General Terms and Conditions (AGB) for the events of the Mozartfest 2020

For reasons of protection against infection (corona pandemic), the following conditions apply to visits to events of the Mozartfest 2020:

1) Conclusion of contract

Tickets for the Mozartfest 2020 must be reserved by telephone before the day of the event at the Mozartfestbüro (Tel. 0931 37 23 36). Tickets must be collected before the day of the event from the ticket office of the Mozartfestbüro, Rückermainstraße 2, 97070 Würzburg (opening hours Mo. - Fr. 10 - 2 p.m.). Tickets not collected by 19 June will be returned to the sales desk.

The contract with the city of Würzburg/Mozartfest (Mozartfest) is concluded upon delivery of the ticket. The present "General Terms and Conditions for the Events of the Mozartfest 2020", which can be viewed at the Internet address https://www.mozartfest.de/service/tickets, apply. The ticket purchaser was made aware of these terms and conditions when booking the ticket and they were handed out to him in printed form together with the ticket.

2) Personalisation, space limitations and transferability of the tickets

The cards are only issued in a personalised and space-bound manner. Tickets entitle only the person in whose name the reservation was made to attend the event in the seat booked for him/her. A choice of seat by the visitors themselves is not possible either at the time of booking or during the event. Seats are allocated solely by the Mozartfest.

The allocation of seats is carried out in compliance with the relevant minimum distances (distance requirement) according to the Infection Protection Act (normally 1.5 m) which are expected to be valid at the time of the event. Seats may be allocated without consideration of the minimum distances within the framework of the capacities for persons for whom it is credibly demonstrated at the time of reservation that and in relation to which other persons a minimum distance according to the general regulations of infection law (contact restriction) cannot be observed at the time of the event, e.g. members of a household. The respective visitor is solely responsible for the correctness and completeness of the information on which the exemption from the requirement to maintain the distance is based.

During the event, visitors must keep an official proof of identity at hand and present it for verification at the request of the Mozartfest or persons commissioned by it. If the proof cannot be presented at the event, the Mozartfest is entitled to expel the person from the event. In this case there will be no refund of the admission price (including fees). This shall also apply if the proof of identity is or could be provided subsequently.

The tickets are not transferable. On request (by telephone is sufficient), the Mozartfest can agree to a transfer of the tickets to another person, provided that the transfer is possible in the course of business and is justifiable from the point of view of infection protection law. There is no right to transfer.

3) Storage of contact data, tracking of possible chains of infection

When reserving tickets, the contact data (first name and surname, telephone number and address, instead of the address optionally a valid e-mail address) must be given completely and truthfully for each visitor. The data will be stored by Mozartfest together with the associated data concerning the visit to the event (date, time, event, seat assignment) for the purpose of complete tracing of possible chains of infection by the responsible authorities. The data will only be stored and passed on for as long as and to the extent necessary for this purpose.

4) Prices, discounts and fees

If an entrance fee is due for the individual event, this is shown on www.mozartfest.de/kalender-tickets. The admission fee (including fees) is payable upon delivery of the admission ticket (cash or EC card). A system fee of 0.50 € is charged per chargeable concert ticket. A processing fee of 4.00 € will be charged for tickets sent by mail.

Pupils, trainees and students (up to the age of 30 and upon presentation of a valid ID) receive a 50% discount on the ticket price.

Holders of a severely handicapped pass with the mark "B" and their accompanying person receive a 50 % reduction on the ticket price.

All tickets for open-air concerts in 2020 will be issued against a donation of any amount ("Pay-what-you-want"). In the event of a cancellation, contrary to point 5, the donations will generally not be refunded.

5) Changes to the program and cast, general conditions at the events and possible changes, exchange of tickets

We reserve the right to make changes to the program and cast; there is no right to cancel tickets due to changes.

Some venues may differ from modern concert halls in terms of acoustics, climate and construction. Due to technical constructions, visual obstructions may occur. In order to reduce contact, the concerts will take place without catering facilities and without cloakrooms. The above-mentioned restrictions do not entitle to return tickets or to reductions.

Official decisions, in particular in connection with the development of the Corona Pandemic, weather conditions or other events beyond the control of the Mozartfest and the visitor, may make it necessary to hold an event in a modified or adapted form, in particular with different or additional rules of conduct for event attendance than those already mentioned in these conditions. Cancellations or premature termination are also conceivable due to the aforementioned circumstances. Conversely, restrictions or conditions in the course of the event as regulated here may be waived if a favourable development of the corona pandemic, in particular the legal situation applicable at the time of the event, allows this. Any changes to the conditions regulated here will be announced to visitors in a suitable manner at the latest upon admission to the event and must be observed in the same way as those already regulated here. As far as possible in the operational course of the Mozartfest, a publication will be made in advance at: www.mozartfest.de/about-us/latestnews. It is recommended that, if possible, visitors inform themselves in advance of any changes for the respective event in this way.

Only in the event that the event is cancelled or abandoned during the first half of the event due to circumstances mentioned in the previous paragraph will the admission fee (incl. system fee, excl. processing fee) be refunded in full. In all other cases there is no claim to a refund of the admission price and fees, even partial.

In all other cases, there is no entitlement to a refund or exchange of tickets already issued.

6) Admission to the events

Access to the event area is usually possible about 30 minutes before the event begins. The exact admission time for the respective event is indicated on the ticket. Late admission to events is at a time determined by the Mozartfest.

Excluded from participation in the events are all persons who

  • knowingly had contact with a confirmed COVID-19 patient within the last 14 days, or
  • show unspecific general symptoms or respiratory symptoms of any severity.

Should persons develop symptoms during the event, they must leave the event immediately and without being asked to do so.

If a visitor misses an event in whole or in part due to the above regulations, there is no right to a refund of the admission price, not even partial.

7) Conduct during the events

After admission, visitors must move quickly and, as far as possible, avoid queues, congestion, etc. to the place reserved for them. If at all possible, they should stay there during the event. An exchange of seats with other visitors is not permitted due to the fact that the tickets are tied to the seats, which is necessary to prevent infection.

As long as visitors remain on the event premises in connection with the event, they must remain on the entire premises before, during and after the event (i.e. not only in the event hall, but also on entrances and exits, corridors, sanitary facilities, etc., whether outdoors or indoors):

  • Maintain a minimum distance of 1.5 m to other persons (distance requirement) and
  • to wear a mouth-and-nose cover.

Visitors for whom, according to generally applicable regulations in the version valid at the time of the event, the obligation to keep their distance (e.g. members of a household) and/or the obligation to wear a mouth-and-nose covering is waived in relation to each other (e.g. impossibility/unreasonableness due to health restrictions), shall be exempt from compliance with the respective obligations, also in connection with their visit to the event, but also only to the extent that these obligations do not apply to them under the general regulations.

Walking routes are marked on the event site to reduce contact. The signposting on site must be observed.

8) Domestic authority, right to issue instructions to the event personnel, exclusion from the event

The Mozartfest staff or other persons commissioned by the Mozartfest to ensure the orderly and safe running of the event (event personnel) exercise the householder's rights at the events.

The instructions of the event personnel must be followed.

If a visitor repeatedly does not behave properly despite appropriate instructions from the event personnel, he can be excluded from the event by the event personnel, especially if he lacks the necessary insight into the offence of his behaviour. In the event of gross violations, in particular those against infection protection regulations, which may lead to the endangerment of one or more other persons, immediate exclusion from the event is also possible.

In the event of exclusion from the event, no claim for reimbursement of the admission price, even in part, shall arise.

House rules, the right to issue instructions and possibilities of exclusion apply in the same way with regard to regulations which are not laid down here, but which the Mozartfest has made known to visitors in a suitable manner at the latest upon admission to the event due to the dynamic legal development of the Corona Pandemic in accordance with the present Section 5).

9) Image and sound rights

Visitors agree to image and/or sound recordings as well as video livestream transmissions of their person during an event. The organizer is entitled to use the material without any claim for remuneration.

10) Liability

The Mozartfest is not liable for material damage, personal injury or financial losses incurred in connection with the event, in particular as a result of an infection with the sars-cov-2 virus attributable to attendance of the event, unless

  • damages resulting from injury to life, body or health due to an intentional or negligent breach of duty by a legal representative or vicarious agent of the Mozartfest or
  • other damages are based on an intentional or grossly negligent breach of duty by a legal representative or vicarious agent of Mozartfest.

11) Invalidity of clauses

Should individual provisions of these GTC prove to be invalid, this shall not affect the validity of the remaining provisions. In place of the invalid provision, the relevant legal regulations shall apply.
